The NSW Government exhibited an Explanation of Intended Effect (EIE) for a proposed Housing Diversity SEPP that would consolidate three current SEPPs:

  • State Environmental Planning Policy (Affordable Rental Housing) 2009
  • State Environmental Planning Policy (Housing for Seniors and People with a Disability) 2004
  • State Environmental Planning Policy No 70 – Affordable Housing (Revised Schemes).

It also proposed to introduce new land use definitions and planning provisions for Build-to-Rent (BTR), student housing and co-living development, as well as amend existing provisions relating to boarding houses and seniors living. LGNSW made a submission on the EIE.

The proposed changes are being implemented in stages. Phase One changes to facilitate delivery of social and affordable housing by the Land and Housing Corporation, changes to the size of secondary dwellings in rural zones and operation of State Environmental Planning Policy (Affordable Rental Housing) 2009 were introduced on 18 December 2020. Phase Two changes, new provisions for build-to-rent housing commenced in February 2021.
