Review of the WHS Regulation

SafeWork NSW has started a review of the Work Health and Safety Regulation 2017 (the Regulation) and is seeking feedback from interested parties.

The Regulation sets out detailed rules and requirements to support the implementation of the Work Health and Safety Act 2011 and the review provides the NSW Government to modernise, improve and streamline processes to strengthen safety standards in workplaces across the State.

SafeWork NSW has published the Work Health and Safety Regulation Remake Discussion Paper, which can be found on the NSW Government Have Your Say Platform here. The Discussion Paper is intended to assist interested parties in providing feedback on any potential amendments to the Regulation.

The Discussion Paper indicates that SafeWork NSW is considering changes to provisions relating to plant and structures, hazardous chemicals and asbestos management.

Local Government NSW is calling on members to indicate if they wish to suggest an amendment or otherwise participate in the review process. If your council wishes to make a submission, or to contribute to the submission of Local Government NSW, please contact Tom Duffy (Senior Industrial Officer) at [email protected] or Mateo Lopez (Industrial Officer) at [email protected] by no later than 1 March 2025.

Consultation will remain open for members to submit individual feedback until 12 March.
