All NSW councils are covered by the terms and conditions of the Local Government (State) Award 2020 and the Local Government (Electricians) (State) Award.

Local Government (State) Award 2020

The Local Government (State) Award 2020 was made by the Industrial Relations Commission of NSW on 26 June 2020.

The 2020 Award took effect on the first full pay period to commence on or after 1 July 2020.

 

The Local Government (COVID-19) Splinter (Interim) Award 2020 

On 14 April 2020 the Local Government (COVID-19) Splinter (Interim) Award 2020 (“Award”)  was made by the NSW Industrial Relations Commission.

The Award applies to all employers named in Schedule A of the Award and to all of their employees, except for employees whose positions are senior staff positions pursuant to sections 332 and 334 of the Local Government Act 1993 (NSW).

In the case of employers named in Schedule A of the Award who are covered by an enterprise agreement, the Award shall apply to such employers and to all of their employees, except for employees whose positions are senior staff positions pursuant to sections 332 and 334 of the Local Government Act 1993 (NSW), as a stand down order pursuant to section 126 of the Industrial Relations Act 1996 (NSW).

The Award is operational on and from 8 April 2020 and shall remain in force until 7 April 2021.

 

Variation to the Local Government (COVID-19) Splinter (Interim) Award 2020

The Industrial Relations Commission of New South Wales has recently varied the Local Government (COVID-19) Splinter (Interim) Award 2020.

Following the Award being made on 14 April 2020, the parties have identified the need for the following variations:

  1. to amend the definition of “LG State Award” to include references to additional awards, including the Local Government (Electricians) (State) AwardLocal Government, Aged, Disability and Home Care (State) Award; and Entertainment and Broadcasting Industry – Live Theatre and Concert (State) Award.
  2. to amend the definition of “Union” to include a reference to the Electrical Trades Union of Australia, New South Wales Branch (ETU); and Health Services Union (HSU); and
  3. to amend subclause 13.10 to clarify that for juniors, trainees and apprentices who receive an ordinary rate of pay below Band1/Level 2, payment of the Job Retention Allowance shall be at their ordinary rate of pay.

The variations clarify that the provisions of the splinter award apply to employees who are employed pursuant to the Local Government (Electricians) (State) AwardLocal Government, Aged, Disability and Home Care (State) Award; and Entertainment and Broadcasting Industry – Live Theatre and Concert (State) Award.

In additional to the 102 councils already covered by the Award, an additional 16 councils have elected to opt-in to the splinter award.

Local Government (State) Award 2017

The Local Government (State) Award 2017 was made by the Industrial Relations Commission of NSW on 30 June 2017.

The 2017 Award took effect on the first full pay period to commence on or after 1 July 2017.

Local Government (Electricians) (State) Award

On 13 September 2018, the Industrial Relations Commission of NSW varied part B monetary rates of the Local Government (Electricians) (State) Award operative from the first full pay period on or after 28 September 2018.

 

State Wage Case 2016

The NSW Industrial Relations Commission varied a number of NSW awards on 6 December 2016 to give effect to its decision in State Wage Case 2016 [2016] NSWIRComm 12.

The rates of pay of the following NSW awards have been increased by 2.4%:

  • Local Government Aged, Disability and Home Care (State) Award
  • Nurses’ (Private Sector) Training Wage (State) Award
  • Nursing Homes, &c., Nurses’ (State) Award.

The above increase may be offset against:

  1. Any equivalent over award payments, and/or
  2. Award wage increases other than state wages case adjustments.

The increase has retrospective operation and takes effect from the first full pay period commencing on or after 28 September 2016.
